FAA Interpretation of Section 136 of FAA Modernization and Reform Act of 2012 (RTTF)

Abstract: On February 14, 2012, the FAA Modernization and Reform Act of 2012 was signed into law (P.L. 112-95). Section 136 of this law permits general aviation airports, as defined by the statute, to enter into residential through-the-fence agreements with property owners or associations representing property owners for non-commercial use. RTTF agreements must comply with specific terms and conditions contained in the law. This document outlines the specific terms and conditions as Congress' intent for the FAA to enforce the provision accordingly. Therefore, the FAA will request sponsors with existing residential through-the-fence agreements to demonstrate their compliance with the law. Additionally, the FAA will request the sponsors of general aviation airports proposing to establish new residential through-the-fence agreements to demonstrate that their agreements will comply with the law.
