Abstract:
Complainant, Corporate Jets, Inc., an FBO, filed a complaint against Respondent, City of Scottsdale, Arizona, owner and operator of the Scottsdale Municipal Airport, alleging that Respondent violated Grant Assurance 22 (Unjust Economic Discrimination) and 23 (Exclusive Right) through its solicitation of bid proposals for an additional FBO and exclusion of Complainant from the bidding process. The Director found Respondent not in violation of these Grant Assurances and dismissed the Complaint.|Economic Nondiscrimination (Grant Assurance 22) and Exclusive Rights (Grant Assurance 23):|Respondent did not grant an exclusive right in violation of Grant Assurance 23 nor unjustly discriminate in violation of Grant Assurance 22 by prohibiting Complainant, the incumbent FBO, from bidding for additional FBO services on the Airport where the goal of the prohibition was to promote competition at the Airport and appeared to be in the best interest of the public in civil aviation.
