Abstract:

On April 24, 2002, the Committee to Stop Airport Expansion, Pat Trunzo III, Pat Trunzo, Jr., and Edward Gorman, Complainants, filed a formal complaint against the Town of East Hampton, New York, Respondent, alleging violations of Grant Assurances 6, 7, and 29. The FAA issued an Order of Dismissal on June 24, 2002 for failure to state a claim, which the Complainants appealed on June 24, 2002. On April 29, 2005, the FAA and Complainants executed a Settlement Agreement resolving the issues between them. In the Settlement Agreement, the Complainants agreed to seek dismissal with prejudice of the proceeding in this docket. The Associate Administrator (1) granted the Complainants’ request for dismissal, and (2) withdrew its June 24, 2002 Order of Dismissal.
